Right of Withdrawal for Consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day,

  • on which you or a third party designated by you, who is not the carrier, have taken or has taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered uniformly;
  • on which you or a third party designated by you, who is not the carrier, have taken or has taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately;
  • on which you or a third party designated by you, who is not the carrier, have taken or has taken possession of the last partial shipment or the last piece, provided that a good is delivered in several partial shipments or pieces.

by means of a clear declaration of your decision to withdraw from this contract, e.g., by email or by post.

You can use the model withdrawal form below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. This excludes additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us.

For this reimbursement, we will use the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any diminished value of the goods if this diminished value is due to handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Notes on Returns

Please do not return goods without prior declaration of withdrawal. For faster processing, we kindly ask you to contact us beforehand by email at support@orthonex.de .

Please include the following information with your return, if possible:

  • Order number
  • Full name
  • Email address
  • Completed return form, if applicable

This information is solely for faster allocation of your return and is not a prerequisite for the effective exercise of your right of withdrawal.
A withdrawal remains effective even if you do not use an internal return form. Requiring a mandatory shop-specific form would be legally problematic.

Exclusion or premature expiration of the right of withdrawal

The right of withdrawal does not apply to contracts

  • for the supply of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
  • for the supply of goods that can spoil quickly or whose expiry date would be exceeded quickly;
  • for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery;
  • for the supply of goods if these were inseparably mixed with other goods after delivery due to their nature.

Especially for orthopedic or body-worn products, the hygiene exemption may be relevant, but only if the goods are actually sealed and the seal was removed after receipt.

Voluntary Return Policy from Orthonex

Irrespective of the statutory right of withdrawal, Orthonex may voluntarily offer an additional return option. This voluntary regulation applies only supplementary and does not affect your legal rights.

If Orthonex grants a voluntary extended return period, the conditions specified on the product page or in the shop policies apply.

Important:
A voluntary return guarantee must not worsen or replace the statutory right of withdrawal. Therefore, formulations like "100 days trial, but only 30% refund for use" should not be mixed with the statutory right of withdrawal. This should be strictly separated as a voluntary additional service . This separation is clearly cleaner from a consumer's perspective and legally.
